These Terms of Service ("Terms") govern your access to and use of Clipperok ("Service", "we", "us", or "our"), an AI-powered video clip creation platform. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Clipperok provides AI-powered video processing and clip creation services, including:

• Video Upload & Download: Upload videos directly or download from YouTube URLs
• AI Transcription: Automatic speech-to-text transcription using Whisper AI
• AI Clip Analysis: Intelligent identification of engaging moments using DeepSeek AI
• Clip Creation: Generate vertical (9:16) or horizontal clips with animated captions
• TikTok Integration: Publish clips directly to TikTok via OAuth
• Video Editor: Manual clip creation with visual timeline and subtitle preview

2. Accounts and Membership

Age Requirement: You must be at least 13 years old to use the Service.

Registration: Create an account by providing a valid email address and password, or authenticate via Google OAuth.

Account Security: You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Providing false information may result in account termination.

Account Suspension: We reserve the right to suspend or terminate accounts that violate these Terms or for any reason at our discretion.

3. User Content

Content Rights: You retain all rights to videos you upload. However, you must be legally authorized to upload and share the content you provide.

License Grant: By uploading content, you grant Clipperok a non-exclusive, worldwide license to process, store, and transform your content solely for the purpose of providing the Service. This includes AI transcription, clip generation, and subtitle creation.

Content Removal: We reserve the right to remove content without prior notice if:

• We receive complaints or copyright infringement notices
• Public authorities order removal
• Content poses risks to users or the Service
• Content violates these Terms or applicable laws

Your Responsibility: You assume sole liability for all uploaded content and warrant that it does not infringe third-party rights.

4. AI Processing and Machine Learning

The Service uses artificial intelligence to analyze and process your videos:

• Whisper AI: Converts speech to text for subtitle generation
• DeepSeek AI: Analyzes transcriptions to identify engaging moments
• FFmpeg Processing: Automated video cutting, formatting, and subtitle rendering

No Model Ownership: You receive no ownership rights to AI models, algorithms, or machine learning outputs beyond the final clips you create.

5. Third-Party Integrations

The Service integrates with third-party platforms. By using these features, you agree to comply with:

• Google OAuth: Google Terms of Service and Privacy Policy apply when using "Sign in with Google"
• TikTok API: TikTok Terms of Service, Community Guidelines, and Privacy Policy apply when publishing clips. You can revoke authorization at any time
• YouTube: When downloading YouTube videos, YouTube Terms of Service apply and you must have necessary rights to the content

6. Prohibited Uses

You agree NOT to use the Service for:

• Unlawful purposes or violation of any laws or regulations
• Infringement of intellectual property or third-party rights
• Harassment, abuse, or discrimination based on protected characteristics
• Uploading malware, viruses, or malicious code
• Spam, phishing, or automated scraping activities
• Circumventing security features or rate limits
• Creating content containing violence, hate speech, or adult material
• Downloading copyrighted content without authorization
• Reverse engineering, decompiling, or attempting to extract source code

Consequences: Violations may result in immediate account termination without refund.

7. Data Retention and Backups

Video Storage: Uploaded videos and generated clips are stored on our servers. We perform regular backups to minimize data loss during hardware failures.

Automatic Cleanup: Video files may be automatically deleted based on age and storage capacity. We recommend downloading your clips promptly.

Account Deletion: Upon account deletion, your videos and clips will be permanently removed from our servers within a reasonable timeframe.

8. Intellectual Property Rights

The Service, including its design, features, code, and trademarks, is owned by Clipperok and protected by copyright and intellectual property laws. You receive no license to reproduce, modify, or distribute our intellectual property beyond normal use of the Service.

9. Disclaimer of Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

• Uninterrupted, timely, secure, or error-free operation
• Accuracy of AI transcriptions or clip recommendations
• That the Service will meet your requirements
• Freedom from viruses or harmful components
• Successful video processing for all formats

You assume all risks associated with using the Service, including data loss or security breaches.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIPPEROK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Lost profits or business opportunities
• Data loss or corruption
• Service interruptions or errors
• Third-party claims related to published content
• Copyright infringement claims

Our total liability for all claims shall not exceed $50 USD or the amount you paid for the Service in the past 12 months, whichever is greater.

11. Indemnification

You agree to indemnify and hold Clipperok harmless from any third-party claims, damages, or expenses (including legal fees) arising from:

• Content you upload or publish
• Your use or misuse of the Service
• Violation of these Terms or applicable laws
• Infringement of third-party rights

12. Changes to Terms

We may update these Terms from time to time. The "Effective Date" at the top indicates the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service immediately ceases, and we may delete your account and content.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the courts of competent jurisdiction.
